Sick leave Netherlands 2026: sick pay, the 104 weeks, reintegration and your rights

Employer stopped paying, pushing you back to work, or offering a VSO while you are sick?

The rules that protect you

  • Pay: your employer keeps paying at least 70% of your wage for up to 104 weeks, and in the first year at least the minimum wage.
  • No notice: your employer cannot dismiss you by giving notice during the first 2 years of illness, with narrow exceptions.
  • Back to work: the company doctor judges what you can do, not your manager. If you disagree, UWV can give an expert opinion.
  • A VSO while sick: sign one while you cannot work and you will probably get no Ziektewet benefit.

Rules from the Civil Code, UWV and Rijksoverheid · Checked 30 September 2026

Short answer

Sick leave Netherlands, in short: in 2026 your employer keeps paying at least 70% of your wage for up to 104 weeks (2 years), and in the first year never less than the minimum wage (Rijksoverheid, UWV, checked 28 September 2026). Your CAO or contract can give you more. You report sick to your employer, the company doctor assesses you by week 6, you agree a plan of action by week 8, and your employer reports you to UWV after 42 weeks. Your employer may not ask what is wrong with you, and may not give notice during the first 2 years of illness.

Key facts for 2026

  • 70% of your wage for up to 104 weeks is the legal minimum sick pay.
  • 52 weeks: in the first year of illness your pay never drops below the minimum wage.
  • 6 weeks: the latest point for the company doctor’s assessment when a long absence is expected.
  • 42 weeks: the day after, your employer must report your illness to UWV.
  • 93rd week at the latest: your WIA application goes in with the reintegration report.
  • 2 years of illness must pass before your employer may give notice, with narrow exceptions.
  • 52 weeks is the most UWV can add to your employer’s sick pay duty as a wage sanction.

Sick pay

Sick leave Netherlands: how much am I paid, and for how long?

Your employer keeps paying at least 70% of your wage for up to 104 weeks, and in the first 52 weeks at least the minimum wage (Civil Code, article 7:629, Rijksoverheid).

Period of illnessMinimum pay by lawWho pays
Weeks 1 to 5270% of your wage, and at least the minimum wageYour employer
Weeks 53 to 10470% of your wageYour employer
Illness from pregnancy, birth or organ donation100% of your wageYour employer
Temporary contract ended while illZiektewet benefit until the 2 years are upUWV

2026. Your CAO or employment contract can give you more.

  • High earners: the 70% applies to pay up to the maximum daily wage, €309.91 gross a day from 1 July 2026 (Ministry of Social Affairs).
  • Second year: no top-up to the minimum wage. If your household income then falls below the social minimum, you can ask UWV for a supplement.
  • Waiting days: your contract or CAO can leave the 1st day, or the first 2 days, unpaid. That does not apply if you fall ill again within 4 weeks (Rijksoverheid).
  • Periods add up: 2 periods of illness less than 4 weeks apart count as 1, which matters for when the 104 weeks end.
  • Losing the right to pay: if you caused the illness on purpose, slow down your recovery, refuse suitable work you can do, or refuse to help draw up or evaluate the plan of action.

Reporting

What can my employer ask when I call in sick?

Under Autoriteit Persoonsgegevens rules, your employer may not ask about 2 things when you call in sick: what is wrong with you and what caused it. The nature and cause of an illness are not information an employer needs.

  • Allowed: your phone number and the address where you stay, how long you think the illness will last, your current tasks and appointments, and whether an accident at work caused it.
  • Even if you tell them: your employer may not record or share what is wrong with you.
  • Checks: your employer may not check whether you are really ill, but can ask the company doctor to. You can be asked to be at home at certain times, not all day.
  • The bedrijfsarts (company doctor): your employer reports your illness to the company doctor or occupational health service, who tells your employer only that you are unfit for work, roughly for how long, and what work you can do (Autoriteit Persoonsgegevens).
  • Your own GP or specialist: they may only pass medical data to the company doctor with your explicit, written consent.

Poortwachter

What has to happen during reintegration, week by week?

Under the Wet verbetering poortwachter (Gatekeeper Improvement Act), the fixed milestones are the company doctor’s assessment within 6 weeks, the report to UWV after 42 weeks and the WIA application by week 93. You and your employer are jointly responsible for your return to work in the first 2 years of illness (Rijksoverheid). What happens after week 104 is covered in our Dutch guide on dismissal after 2 years of sickness (ontslag na 2 jaar ziekte), including the UWV permit and the WIA deadline.

WhenWhat happens
When you fall illYou report sick to your employer, and your employer reports your illness to the company doctor or occupational health service. How and when follows your employer’s own rules
Week 6The company doctor gives an assessment of what you can and cannot do when a long absence is expected: the probleemanalyse (problem analysis)
Week 8 (within 2 weeks after that)You and your employer agree a written plan of action, with a named case manager
RegularlyThe plan is evaluated and adjusted when needed
Week 42Your employer reports your illness to UWV at the latest on the first working day after week 42: the 42e-weeksmelding (42-week sick report). A late report can cost the employer a fine of up to €455
Week 52, end of the first yearYou and your employer fill in the first-year evaluation together: it looks back and asks whether return at your own employer is still realistic
Within 6 weeks after thatA second track, work with another employer, starts if return at your own employer is not in sight
Around week 88UWV writes to you about applying for WIA, with the deadline. Around week 91 you and your employer complete the final evaluation for the reintegration report
Week 93 at the latestYou apply for WIA, with the reintegration report
After 104 weeksSick pay ends and UWV decides on the WIA benefit

Deadlines from the Regeling procesgang eerste en tweede ziektejaar, the Ziektewet and the UWV Werkwijzer Poortwachter, and UWV’s step-by-step guide to employee sickness and 42-week report page, checked 28 September 2026. You and your employer may depart from the 6-week and 2-week deadlines if you give reasons.

  • The sources: the assessment and plan (Regeling procesgang), the report to UWV (Ziektewet, article 38), the second track and the WIA application (UWV Werkwijzer Poortwachter).
  • Back to work step by step: fewer hours for a while, an adapted workplace, or other work, possibly seconded to another employer. Rijksoverheid describes a progress talk every 6 weeks.
  • Wage sanction: if UWV finds the employer’s efforts insufficient, it can extend the duty to pay your wages by up to 52 weeks. After repairing the gaps, the employer can ask to shorten it.
  • Longer on purpose: you and your employer can ask UWV together to extend sick pay voluntarily — there is no fixed deadline, though UWV prefers the request before the 104-week waiting period ends (Arboportaal).

Dismissal

Can my employer fire me while I’m sick?

Your employer cannot give notice while you are unfit for work through illness, until the illness has lasted at least 2 years (Civil Code, article 7:670).

“De werkgever kan niet opzeggen gedurende de tijd dat de werknemer ongeschikt is tot het verrichten van zijn arbeid wegens ziekte, tenzij de ongeschiktheid: a. ten minste twee jaren heeft geduurd …”

Our translation: “The employer cannot give notice during the time that the employee is unfit to perform their work because of illness, unless the unfitness: a. has lasted at least two years …” From Civil Code, article 7:670, paragraph 1, checked 25 September 2026.

  • The exceptions: the illness began after UWV received your employer’s request for a dismissal permit; you are in your probation period; a summary dismissal; or you do not cooperate with reintegration without a good reason (UWV).
  • Ill during your proeftijd (probation period): your employer may still end your contract, and falling ill does not make the probation period longer. You can then get a Ziektewet benefit from UWV; if you resign yourself, you probably get none (Rijksoverheid, UWV).
  • Do not resign: if you resign while ill, you lose your sick pay and will probably get no Ziektewet benefit.
  • Settlement agreement: signing one while you are still unfit for work probably means no Ziektewet benefit. You can dissolve the agreement in writing within 14 days, or 3 weeks if it does not mention that right. Read our settlement agreement guide first.
  • After 2 years: your employer may dismiss you. See what to do when you are dismissed and notice periods.

Temporary

What happens if my temporary contract ends while I’m sick?

If your temporary contract ends while you are ill, UWV takes over the payments from that date until the 2 years are up (Rijksoverheid).

  • No renewal needed: your employer does not have to renew the contract, and reports you to UWV as sick when you leave. You can then get a Ziektewet benefit (UWV).
  • Guidance moves too: UWV also becomes responsible for your guidance and reintegration.
  • Ill for more than 6 weeks: you and your employer draw up a reintegration report, which you need for the Ziektewet application. If UWV finds too little was done, it can recover the benefit from the employer or lower your benefit.
  • Resigning early: no Ziektewet benefit until the original end date of the contract.

Holidays

Do sick days during my holiday count as holiday?

Days on which you are ill during a planned holiday do not count as holiday, unless you agree (Civil Code, article 7:638).

  • Extra days only: a written agreement can count those days as holiday only up to your extra, non-statutory days. Your employer may only ask you to swap extra days for sick days if you agreed that in advance or agree now (Rijksoverheid).
  • Holiday while ill: you still have a right to holiday. Ask your employer first; during those days you are paid 100%, even if you normally get 70% (Rijksoverheid).
  • Paid too little before? You may be able to claim the difference for the past 5 years. More in our holiday allowance guide.

Burnout

Burnt out at work: sick pay, the company doctor and going back

Burnout is treated like any other illness: if you cannot work, the same sick pay and dismissal rules apply. The Civil Code’s sick pay rule covers being unable to work through illness, pregnancy or birth, and has no separate rules for burnout or other mental health problems (Civil Code, article 7:629).

  • Pushed back too soon: you can ask for a second opinion from another company doctor. You or your employer can also ask UWV for an expert opinion (deskundigenoordeel) on whether you can do your own work; for an employee it costs €100. It is advice, but UWV uses it when it assesses the reintegration report for a WIA application (UWV).
  • Going back step by step: fewer hours or adapted work are part of the plan of action; see the Poortwachter steps.
  • Pay stopped: your employer may only stop or hold back sick pay for reasons the law lists, such as refusing suitable work or not cooperating with the plan of action without a good reason, or not following written instructions about the information your employer needs (Civil Code, article 7:629).
  • Offered a VSO while burnt out: if you are still unfit for work when you sign, you will probably get no Ziektewet benefit (UWV). Read our settlement agreement guide first.
  • Who decides: only the company doctor or occupational health service may judge how the illness affects your work, not your employer (Autoriteit Persoonsgegevens).
  • Your privacy: the same rules on what your employer may ask apply, whatever the illness.
  • Pregnancy: illness from pregnancy or birth is paid at 100%; see our maternity leave guide.

FAQ

Frequently asked questions

How does sick leave work in the Netherlands?

Your employer reports your illness to the company doctor or occupational health service and keeps paying at least 70% of your wage, for up to 104 weeks. In the first year that is never less than the minimum wage. You and your employer then work on your return under the Poortwachter rules, and after 2 years UWV looks at whether you qualify for a WIA benefit.

How much sick pay do you get in the Netherlands?

At least 70% of your wage, and in the first year at least the minimum wage. In the second year it stays at 70% without that top-up; if your household income then falls below the social minimum, you can ask UWV for a supplement. Your CAO or contract can give more, and illness from pregnancy, birth or organ donation is paid at 100%.

What is the Wet verbetering poortwachter?

It is the Dutch law that makes employer and employee jointly responsible for getting a sick employee back to work in the first 2 years. The company doctor gives an assessment within 6 weeks, a written plan of action follows within 2 weeks, it is evaluated regularly and at the end of the first year, and the reintegration report goes to UWV with the WIA application.

What can my employer ask when I call in sick?

Only what they need to organise the work and to decide about your pay: how to reach you and where you stay, how long you expect to be ill, your tasks and appointments, and whether an accident at work or a traffic accident caused it. Your employer may not ask what is wrong with you, and may not record it even if you tell them.

Can you be fired while on sick leave in the Netherlands?

Not by notice during the first 2 years of illness, unless the illness started after UWV received your employer’s request for a dismissal permit. You can be dismissed during probation, on the spot for an urgent reason, or if you refuse to cooperate with reintegration without good reason. Do not sign a settlement agreement while ill without advice: you will probably get no Ziektewet benefit.

Can I be fired if I am sick during my probation period?

Yes. Your employer may end your contract during the probation period even if you are ill, and being ill does not extend the probation period, which is never longer than 2 months. If you are dismissed in your probation period while sick, you can get a Ziektewet benefit from UWV. If you resign yourself while sick, you will probably get no Ziektewet benefit.

What penalty does an employer face for a poor reintegration?

If UWV finds the reintegration efforts insufficient when it handles the WIA application, it can extend the employer’s duty to pay your wages by up to 52 weeks. This is the wage sanction. Once the employer has repaired what was missing, they can ask UWV to shorten it. Employees who refuse to cooperate risk losing their sick pay.

What happens if my temporary contract ends while I am sick?

Your employer does not have to renew it and reports you to UWV as sick when you leave. UWV then takes over the payments through a Ziektewet benefit, from the end date of your contract until the 2 years are up, and also takes over your guidance and reintegration. If you resign yourself, you get no Ziektewet benefit until the original end date.

Do sick days during my holiday count as holiday?

No. Days on which you are ill during a planned holiday do not count as holiday unless you agree. A written agreement can only make them count against your extra, non-statutory holiday days. You can also take holiday while you are ill, with your employer’s permission, and you are then paid 100% for those days.
