Losing your job on a highly skilled migrant permit
Your residence permit is tied to your employer. When the contract ends, a search period starts and your right to stay runs on a deadline that most people calculate too late. Here is how the clock actually works.
Tell us what happenedWhen a highly skilled migrant employment contract ends, the IND applies a job search period of up to three months, or up to six months if you have held the permit for more than two years. The period starts on the contract end date and can never run past the expiry date on your residence card.
For most employees in the Netherlands, losing a job is a financial problem. For a highly skilled migrant (kennismigrant), it is a financial problem and a residence problem running on two different clocks at once. The employment side has its own deadlines. The immigration side has a job search period that starts the moment your contract ends and cannot be extended by negotiation.
The most common and most expensive mistake we see is treating these as sequential: settle the employment matter first, deal with the permit afterwards. By the time the settlement agreement is signed, the end date is fixed, and that date has already set your immigration deadline.
Search period essentials
- Standard search period: up to 3 months from the date the employment contract ends
- Longer period: up to 6 months where the highly skilled migrant permit has been held for more than 2 years
- Hard ceiling: the search period can never extend beyond the expiry date printed on your residence card
- Start date: the contract end date, not the date you were told, and not your last day in the office
- New employer requirement: must be an IND recognised sponsor, and must notify the IND within the required period
- Salary requirement: the threshold that applies on the start date of the new contract, published by the IND and revised each year

1. How the search period works
A highly skilled migrant permit is granted on the basis of employment with a recognised sponsor, and its validity is linked to the duration of that employment contract up to a maximum of five years. When the employment ends, the basis for the permit falls away, but the IND does not withdraw it immediately. It applies a job search period during which unemployment by itself is not treated as a reason to withdraw residence.
The current IND position is up to three months, extending to up to six months where the permit has been held for more than two years. This reflects the protection in the revised EU single permit rules for third-country nationals during unemployment. In practice the IND will typically issue an intention to withdraw the permit, and the search period is recorded in that letter or in the eventual decision.
| Situation | Search period | Practical deadline |
|---|---|---|
| Permit held less than 2 years, card valid well beyond | Up to 3 months | Contract end date plus 3 months |
| Permit held more than 2 years, card valid well beyond | Up to 6 months | Contract end date plus 6 months, confirm with the IND |
| Residence card expires within the search window | Shortened | The card expiry date, whichever comes first |
| Contract ends after the card has already expired | No search period to rely on | Immediate advice needed on your residence basis |

2. Why the settlement agreement end date is an immigration decision
Most highly skilled migrant terminations happen through a vaststellingsovereenkomst (settlement agreement). The end date in that document is the date your search period starts from, which makes it one of the most consequential numbers in the agreement. Before you sign a settlement agreement that sets your contract end date, you can have an immigration lawyer in the Netherlands check how it affects your search period.
- A later end date extends your search window. Being placed on garden leave until a later date keeps you employed, paid and on a running permit.
- An accelerated end date shortens it, even if the total money is the same. Employers often prefer a quick exit; that preference costs you weeks of permit time.
- Respecting the notice period matters twice: for benefit assessment and for the length of your search window.
- Ask for a reference statement in writing. You will need to move fast with new sponsors, and a pre-agreed statement removes friction.
Our companion guide covers the rest of the document in detail: the vaststellingsovereenkomst and the 14-day reflection period.
3. Your first week: a working checklist
- Photograph your residence card and write down the expiry date. Every calculation on this page depends on it.
- Establish the exact contract end date from the termination letter or the draft settlement agreement, not from what was said in the meeting.
- Calculate both dates and diary the earlier one, then work backwards to set a target for having a signed new contract.
- Check the IND recognised sponsor register before you invest time in any application. Our guide to visa sponsorship jobs explains how to search it. An employer who is not a recognised sponsor cannot hire you on this permit route.
- Check the current salary threshold on the IND required amounts page for the threshold that will apply on your new start date.
- Do not sign the settlement agreement until the end date has been assessed against your permit position.
- Register for benefit and check your insurance promptly, and keep your health insurance running throughout.

4. Alternative routes if the search period will not be enough
If a qualifying job is unlikely within the window, the question becomes whether another residence basis fits your situation. These routes have their own conditions, evidence requirements and processing times, and some must be applied for while you still hold lawful residence, which is why they are worth exploring early rather than in the final fortnight.
- Orientation year for highly educated persons (zoekjaar): available to those who qualify on the basis of a recent degree or prior permit history. Our orientation year visa guide sets out who qualifies.
- Self-employment permit: assessed on a business plan and evidence, and processing takes longer than an employment-based application.
- Partner or family route: depends on a qualifying relationship and income conditions on the sponsoring side.
- EU Blue Card: a separate scheme with its own, higher salary threshold and different sponsor rules.
- Study route: enrolment at a recognised institution, which changes your work rights as well as your residence basis.

5. The permanent residence consequence people miss
Permanent residence and naturalisation both rely on a continuous period of lawful residence. A gap created by a withdrawn permit can interrupt that count, which means a few weeks of lost status early can push a permanent residence application back by years.
If you are close to a five-year milestone, that changes the calculation about which route to take and how much to concede on the employment side. It is worth raising explicitly with an advisor rather than treating the job search as the only objective.
6. Employment claims do not pause for immigration
While the search period runs, employment law deadlines run too, and they are short. If you were dismissed rather than settled, there are statutory windows to challenge the dismissal or claim the transition payment, and they are measured in weeks after the employment ends.
- Transition payment: in principle due from the first working day of employment where the employer ends the contract, including where a fixed-term contract is not renewed.
- Challenging the dismissal itself: subject to a strict statutory deadline running from the end of the employment.
- Unpaid wages, holiday and bonus: separate claims which broad settlement wording can extinguish.
Our guide to the deadline for challenging a Dutch dismissal sets out those windows.

7. Frequently asked questions
My employer says they have to report the termination to the IND. Is that right?
Yes. A recognised sponsor has notification duties towards the IND, including reporting relevant changes such as the end of the employment. You should not rely on their reporting as a substitute for tracking your own deadline.
Can I leave the Netherlands during the search period?
Travel while your residence basis is uncertain creates re-entry risk, especially where a withdrawal decision is pending or your card is close to expiry. Get advice on your specific position before booking anything you cannot change.
Does my 30% ruling continue with a new employer?
The ruling is linked to the employment relationship, and continuing it with a new employer requires a fresh request within the applicable time limit after the change. The tax position is separate from the residence position and should be checked alongside it.
What about my partner and children?
Dependent permits are derived from the main permit holder’s residence, so a change to your status affects theirs. This is one of the strongest reasons to get advice at the start of the search period rather than the end.
The new salary offer is slightly below the threshold. Does that work?
No. The salary criterion is a statutory minimum checked against the contract, and a shortfall leads to refusal. Which threshold applies depends on your age and history, so confirm the exact figure on the IND required amounts page before signing.
